These Terms and Conditions ("Terms") govern access to and use of the digital platform empresasi.org operated by Fundación Empresas Indígenas ("FEI"). By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, please refrain from using the service.
1. The Service
empresasi.org is a digital platform whose mission is to strengthen the business ecosystem of indigenous peoples in Chile and worldwide. It offers the following main services:
- AI Assistant: advisory chat for indigenous entrepreneurs on formalisation, financing, and business management.
- Indigenous Directory: voluntary public registry of indigenous-owned or managed businesses.
- Indigenous Business Seal: information and application for the certification process.
- Indigenous Business Network: information about the business articulation programme.
- Learning resources and sector news.
2. Acceptance and Capacity
To use services that require registration, you declare that you are over 18 years of age and have legal capacity to contract. By submitting a form or starting a chat session, you expressly accept these Terms and our Privacy Policy.
3. Permitted Use
The platform is available to entrepreneurs, businesses, and organisations linked to indigenous peoples, as well as to institutions supporting the sector. You agree to:
- Provide truthful and up-to-date information when registering or completing forms.
- Not use the platform for illegal, fraudulent, or harmful activities.
- Not attempt to access without authorisation any systems, data, or accounts of other users.
- Not reproduce, distribute, or commercialise platform content without FEI's written authorisation.
- Not overload or interfere with the technical operation of the service.
4. Artificial Intelligence Assistant
The advisory chat is powered by Anthropic's language models (Claude). Generated responses are informational and guidance-only; they do not constitute professional legal, tax, accounting, or financial advice. FEI does not guarantee the accuracy, completeness, or suitability of responses for your particular situation.
For decisions of significant legal or economic relevance, we recommend consulting a licensed professional. FEI will not be liable for losses or damages arising from relying solely on the AI assistant's responses.
5. Indigenous Directory
Listing your business in the Indigenous Directory is entirely voluntary and requires your express consent. You may request modification or removal of your listing at any time by writing to proyectos.ia@empresasindigenas.org. FEI reserves the right to remove from the directory any listing containing false information or that violates these Terms.
6. Intellectual Property
All intellectual property rights in the platform, its design, source code, editorial content, the "Empresa Indígena" brand, and the Indigenous Business Seal belong to Fundación Empresas Indígenas or its licensors. Access to the platform does not grant you any rights over these elements.
By submitting content to the platform (business descriptions, images, etc.), you grant FEI a non-exclusive, royalty-free, transferable licence to use that content in the context of service provision.
7. Limitation of Liability
FEI does not guarantee uninterrupted availability of the platform. We will make reasonable efforts to keep the service operational, but may temporarily suspend it for maintenance, updates, or causes beyond our control.
To the maximum extent permitted by Chilean law, FEI will not be liable for indirect damages, loss of profits, data loss, or similar harm arising from use or inability to use the platform.
8. Service and Terms Amendments
FEI may modify, suspend, or discontinue any service functionality at any time. We may also update these Terms. Material changes will be notified at least 15 days in advance via a notice on the site or by email. Continued use of the service after the new Terms take effect will imply your acceptance.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Chile. For disputes that cannot be resolved amicably, the parties submit to the jurisdiction of the Ordinary Courts of Justice of the city of Santiago, Chile.
